Terms of Use
Two texts govern your use of Arrow App: the Copyright License Agreement and the Safety Disclaimer. The app shows both at first launch and records your acceptance.
Copyright Agreement
Arrow App is protected by copyright
This Copyright License Agreement (the “Agreement”) is between Arsham Mehrani (the “Owner”) and you (the “User”). It becomes effective on the date you accept it in the app, and it continues until it is terminated under clause XI.
The Owner owns all proprietary rights in and to Arrow App: the app, its interface, its scoring engine, its arrow detection model, its graphics and its text (together, the “Property”). The Owner retains every right that this Agreement does not grant, including all copyrights that the law grants or will grant.
This Agreement is governed by the laws of the place where the Owner resides. The parties agree to the terms below.
I. Grant of License
The Owner grants the User a non-exclusive, non-transferable license to use the Property. The Owner retains title and ownership of the Property.
II. Scope and Limitations
The license covers personal use of the app, on devices the User owns, worldwide. It grants no commercial right: the User may not sell, rent, sublicense or distribute the Property or any part of it.
III. Rights and Obligations
The User is the sole owner of the works the User creates with the app: photos, videos, scores and profile (the “User Work”). Ownership of the User Work includes no ownership of the copyright in the Property. Where the law protects moral rights, the Owner holds them in the Property, and may act if the Property is defamed or altered without permission.
IV. Payment
This license carries no royalty and no fee. Any price for the app itself is set on the App Store.
V. Modifications
The User may not modify the Property, may not reverse engineer it, and may not extract the arrow detection model or any other component. The User may not use the Property for any purpose that is unlawful or that this Agreement prohibits.
VI. Defaults on Agreement
If the User fails to follow an obligation of this Agreement, the Owner may cancel the license. The User may prevent the cancellation with a corrective action, if the Owner accepts that action in writing.
VII. Warranties
The Property is provided “as is”, without warranty of any kind. To the maximum extent the law permits, the Owner is not liable for direct, indirect, special, incidental or consequential damages related to the Property.
VIII. Transfer of Rights
The User may not assign this Agreement, or any interest in it, to another person without the prior written consent of the Owner.
IX. Indemnification
The User agrees to hold the Owner harmless from any third-party claim, loss or damage that arises from the User’s breach of this Agreement. This clause survives the termination of this Agreement.
X. Amendment
The Owner may amend this Agreement. An amended version appears in the app, and continued use of the app requires a new acceptance.
XI. Termination
The User may terminate this Agreement at any time, with the deletion of the app and of every copy of it. The Owner may terminate it under clause VI. On termination, the User must stop all use of the Property. Termination does not extinguish an obligation that by its terms continues.
XII. Severability
If a court holds a provision of this Agreement invalid or unenforceable, the remaining provisions stay valid. If a limited form of the provision would be valid, the provision applies in that limited form.
XIII. Entire Agreement
This Agreement, together with Apple’s standard Licensed Application End User License Agreement, contains the entire agreement of the parties about the Property, and supersedes any prior agreement.
XIV. Disputes
The parties will first try to resolve a dispute under this Agreement directly. A dispute they cannot resolve goes to binding arbitration in the jurisdiction named above, and each party carries an equal share of the arbitration costs.
Acceptance
The User accepts this Agreement with the “I Have Read and Agree” button in the app. The app records the date of the acceptance and shows it in Settings. That record takes the place of a signature.
Safety Disclaimer
Protect yourself at all times
Archery involves projectiles that can cause serious injury or death. By using Arrow App’s capture modes, you agree to the following:
- Never stand in front of a target, downrange, or anywhere in an arrow’s possible path while shooting is in progress: not to position your phone, not to check a score, not for any reason.
- Set up your device and start a capture session only when the range is cold (no one is shooting) and return behind the shooting line before shooting resumes.
- Always follow the safety rules of your range and the instructions of range officers. Local rules take precedence over anything this app suggests.
- Keep bystanders, children, and animals clear of the shooting lane and target area at all times.
- Arrow App’s detections and scores are informational only. They may be incomplete or wrong, and must never be used to decide whether it is safe to approach a target.
Your phone at the target
- A sweep and a photo capture take your phone to the target. Walk up only when the range is cold, and return behind the shooting line before shooting resumes.
- Never leave your phone near the target while anyone shoots. An arrow may strike it, and Arrow App is not responsible for damage to your device or any other equipment.
Limitation of liability
Arrow App is provided “as is”, without warranty of any kind. To the maximum extent permitted by law, the developer accepts no liability for any injury, death, or damage to persons, property, or equipment arising from use of this app, including damage to devices placed near targets. You are solely responsible for your own safety and for complying with all applicable laws and range regulations.
